What is a patent?
A patent is an exclusive right granted by the competent administrative authorities in a given country for an invention that is new, involves an inventive step and is capable of being used in industry (i.e. is industrially applicable).
In general, an invention should be understood as a new and inventive solution to a technical problem in any field of technology. Inventions can also be protected by registering a utility model, if the country concerned provides this type of protection for inventions.
Besides the technological aspects of the invention, other types of protection regarding the brand and/or the aesthetic characteristics of a product can be obtained through trademark registration and/or industrial design registration, respectively.
Trademark registration in Bulgaria
A trademark can be registered in various jurisdictions. Owners of a business that operates only in Bulgaria normally want to register their trademark only within the country. Naturally, this is also a considerably cheaper option than, for example, registering an EU trademark.
When a trademark is registered only in Bulgaria, anyone else can register the same trademark in their own country. They can also register it in the rest of the EU. This, however, does not in any way affect the holder of the trademark rights in Bulgaria, and it continues to be protected here.
